Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Reclaim Growth, a brand operated by Lian Turc Inc. ("we", "our", or "us"). By subscribing to our services, you agree to these Terms.
1. Services
We provide fractional Chief Growth Officer services, including strategic advisory, growth analysis, and execution guidance. Services are delivered through calls, emails, messages, and our proprietary tools and frameworks. Specific service levels depend on your subscription tier. While we collaborate closely, you remain responsible for implementing recommendations and business decisions within your company.
2. Payment
Services are billed in advance on a monthly or quarterly basis as selected during signup. Subscriptions automatically renew each billing period until canceled. All fees are non-refundable except as described in Section 4 (ROI Guarantee). Payment failure may result in service suspension.
3. Cancellation & Pause
Your Cancellation: You may cancel your subscription anytime by emailing billing@reclaimgrowth.com. Cancellation takes effect at the end of your current billing period. Any charges that occur between your cancellation request and when it's processed will be fully refunded.
Our Termination: We reserve the right to terminate your subscription at our discretion with notice. If we terminate without cause, we'll refund any unused portion of prepaid fees. If we terminate for violation of these Terms, no refund will be provided.
Pause: You may pause your subscription for up to 30 days by emailing billing@reclaimgrowth.com. Pause requires confirmation from our team and takes effect on the day we confirm it. Your subscription will automatically resume after the pause period ends.
Custom Requests: For any requests outside these standard terms (immediate cancellation, extended pause, etc.), we're happy to discuss alternatives. While we can't guarantee accommodation, we'll always consider your situation.
4. Guarantees
Specific Business Outcomes
Due to the collaborative nature of our relationship with customers, we cannot guarantee specific business outcomes such as "+65% gross profit within 30 days" or any other time-bound performance targets. Success depends on both parties working together and can be influenced by market conditions and factors beyond our control.
ROI Guarantee
However, to ensure customer satisfaction, we offer a conditional ROI Guarantee which, when included in your subscription, allows you to request a refund for up to three (3) months of fees paid to us if eligible.
Eligibility Requirements:
To invoke the ROI guarantee, you must:
Cancel your subscription via email (see Section 3).
Request the guarantee in your cancellation email (not requesting means waiving the guarantee).
Have implemented agreed-upon strategies and recommendations during the engagement.
Have not received any measurable value during the entirety of our engagement in excess of the amount of fees you paid us.
Have not paused your subscription (pausing voids the guarantee for all fees paid prior to the pause).
Not be in violation of these Terms or any other agreements with us.
If approved, refunds will be processed promptly, typically within 30 days. This guarantee is your exclusive remedy for service dissatisfaction.
5. Intellectual Property
We retain ownership of our pre-existing materials, methodologies, and tools. You may not resell, redistribute, or share our materials with third parties, or claim them as your own creation.
Custom recommendations and strategies we develop specifically for your business become your property. You're free to implement and continue using them after our engagement ends.
6. Confidentiality
All communications between us (emails, messages, calls) and any business information shared during our engagement are considered confidential. Neither party may share the other's confidential information without explicit written consent.
Exceptions: Information that is publicly available, independently known, or required to be disclosed by law. However, even public information should not be shared in a manner that associates it with our engagement without consent.
This obligation survives termination for 5 years.
7. Limitation of Liability
OUR TOTAL LIABILITY FOR ANY CLAIMS IS LIMITED TO THE FEES YOU PAID IN THE 3 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR LOST PROFITS, REVENUE, DATA, OR INDIRECT DAMAGES.
This limitation does not apply to breaches of confidentiality or willful misconduct.
8. Prohibited Use
You may not:
Resell or redistribute our services or materials
Use our services for illegal purposes
Share access credentials with others
Reverse engineer our methodologies or tools
9. Amendments
We may update these Terms by posting revised versions on our website. Continued use after changes constitutes acceptance. Material changes affecting existing subscribers will be communicated via email. The "Last updated" date at the top of these Terms reflects the latest revision.
10. Dispute Resolution
Disputes will be resolved through binding arbitration in Sacramento, California under the American Arbitration Association's Commercial Arbitration Rules, except for claims qualifying for small claims court. You waive any right to class actions.
11. General
These Terms constitute the entire agreement unless modified by a signed written amendment. Our relationship is that of independent contractors. While we serve as your growth partner, this does not create an employment, legal partnership, or joint venture.
Neither party is liable for delays or failures caused by events beyond reasonable control. If any provision of these Terms is found unenforceable, the remaining provisions continue in effect. These Terms are governed by California law, without regard to its conflict-of-law rules.
